Surf to Ski Retreats Gift Card Giveaway
The Surf to Ski Retreats Gift Card Giveaway is intended for participation only in the United States and shall be construed according to, and governed exclusively by, United States law. Do not participate in the Giveaway unless you meet the eligibility requirements set forth below and are physically located in the United States at the time of entry.
1. PROMOTION DESCRIPTION. The Surf to Ski Retreats Gift Card Giveaway ("Giveaway") begins online 11/1/2008 at 12:00:01 AM Pacific Time ("PT") and ends on 10/31/2009 at 11:59:59 PM PT (the "Giveaway Period"). One (1) monthly prize winner will receive one (1) gift card with a face value of U.S. $50 ("Monthly Prize"). The total number of available prizes is twelve (12). The total combined Approximate Retail Value of all prizes is U.S. $600. To enter, book a vacation rental online through Surf to Ski Retreats during the Giveaway Period and you will be automatically entered to win. The odds of winning a prize are determined by the total number of monthly eligible entries received for the random drawing in the Giveaway. Book as many vacation rentals, as you like, to increase your odds of winning the monthly prize, or to win in more than one month. Twelve (12) prizes available to be won (one per month; each valued at $50). In order for a drawing to take place, there must have been at least four (4) eligible online bookings made for that month. 2. ELIGIBILITY. To enter the Giveaway, you must (a) be a lawful permanent resident of the 50 United States, District of Columbia; (b) be of legal age of majority in your jurisdiction of residence (and at least 18 years of age or older in the US) at the time of entry, (c) book a vacation rental through Surf to Ski Retreats. This Contest is void outside the 50 United States and the District of Columbia, and where prohibited or restricted by law. This Contest and any advertisements relating thereto are intended for viewing only within the 50 United States, District of Columbia. Employees, officers, directors and agents of Surf to Ski Retreats ("Sponsor"), and its parents, subsidiaries, affiliates, retailers and advertising or promotion agencies and vendors (collectively, "Giveaway Entities"), and the immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and household members of all such persons, whether or not related, are not eligible to enter this Giveaway. By participating in the Giveaway, each participant (and his or her parent or legal guardian if participant not of age of majority in his or her state or province of residence) agrees to abide by these Official Rules and the decisions of Surf to Ski Retreats, which shall be final and binding in all respects.
3. GIVEAWAY PERIOD. The Giveaway begins online 11/1/2008, 12:00:01 AM Pacific Time ("PT") and ends 10/31/2008, 11:59:59 PM PT (the "Giveaway Period"). During the Giveaway Period, one (1) monthly prize winner will be selected at random by Sponsor. The dates of the Monthly Contest Periods are provided in paragraph 7 below.
4. HOW TO ENTER. To enter visit SurfToSkiRetreats.com ("Website") during the Giveaway Period and book a vacation rental on the Website. To be eligible to win, all entries must be received during the Giveaway Period. To be eligible for a particular monthly drawing, all reservations must be completed in the related Monthly Contest Period (defined in paragraph 7 below). You can enter as many of the Monthly Contest Periods as you would like. Entries not selected as a potential Monthly Contest Period Winner for the week in which the entry was submitted to the Giveaway are not carried over for subsequent Monthly Prize drawings.
The Giveaway Website's database clock will be the official timekeeper for this Giveaway. Incomplete entries will be disqualified. Cancelled bookings will be disqualified. You must book and complete a reservation in order to be eligible to win a Monthly prize. Proof of entering information at the Giveaway Website is not considered proof of delivery to or receipt by Sponsor of such entry. In the event of a dispute regarding the individual who actually submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email address supplied at the time of entry. "Authorized account holder" is defined as the natural person to whom the applicable email address has been assigned by the Internet Access Provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted entry. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the submitted entry. If a dispute cannot be resolved to Sponsor's satisfaction, the entry will be deemed ineligible.
Entry in the Giveaway does not constitute entry into any other promotion, contest or sweepstakes.
NOTE: Entry must be made on the Internet by the entrant, only at the Giveaway Website. Entries made by any other individual or any entity, and/or originating at any other Website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Giveaway. The use of any device to automate the entry process is prohibited.
5. ODDS OF WINNING: Odds of winning a particular Monthly Prize depend on the total number of eligible entries received during the related Monthly Contest Period in the Giveaway. You may enter as many of the Monthly Contest Periods as you like and can win more than one Prize.
6. WINNER SELECTION: One (1) potential winner for each Monthly Contest Period of the Giveaway will be determined by a monthly random drawing by Surf to Ski Retreats, whose decision is final in all matters relating to this Giveaway. The monthly random drawing will be based on the entries made during the previous Monthly Contest Period.
Potential winners will be notified via email (using the email provided with their submission) within ten (10) business days of the drawing. Potential winners may be required to respond by email and/or execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release and an IRS W-9 form within ten (10) days of issuance. If a prize notification or a prize is returned to Sponsor or their fulfillment companies as undeliverable for any reason, the initially selected winner will be disqualified and the applicable Monthly Prize may be awarded to an alternate entrant. No substitution for a prize will be permitted. Prizes are not transferable, assignable or redeemable for cash. No duplicate prizes will be awarded to any one individual or household. Prizes are subject to availability at time of drawing. Surf to Ski Retreats reserves the right to change the list of retailers the winner may choose from.
Entries not selected as a potential Monthly Contest Period Winner for the month in which the entry was submitted to the Giveaway are not carried over for subsequent Monthly Prize drawings.
7. MONTHLY CONTEST PERIODS (each a "Monthly Contest Period"): Each Monthly Contest Period begins online on the first of each month at 12:00:01 AM PT and ends on the last day of the month at 11:59:59 PM PT.

8. PRIZE DETAILS: Monthly Prize: Each Monthly Prize Winner will receive one (1) gift card from a single retailer with a face value of $50 (ARV: U.S. $50). The Monthly Prize Winner may select to receive a gift card from only one of these retailers:

The total number of available Prizes is 12. Total combined ARV of all Prizes: $600. Gift cards are subject to the terms and conditions generally applicable to the respective retailer’s gift cards.
9. PRIZE RESTRICTIONS / CONDITIONS: Prizes will be awarded only if the potential winner fully complies with these Official Rules.
Prizes are non-assignable and nontransferable. No cash alternative or substitution of any Prize will be allowed, except Sponsor reserves the right in its sole discretion to substitute a prize(s) of comparable value (or, if Sponsor so elects, the cash value thereof) if a Prize is unavailable for any reason. Prizes will be fulfilled within four (4) weeks, or as soon thereafter as reasonably practicable. If a Prize winner makes any false statement in any document related to the Giveaway, or if it is discovered that a winner has registered for the Giveaway online simultaneously using more than one email address, the winner will be required to promptly return to Sponsor upon demand her or his Prize(s) or, if any or all of the Prize has been used, the cash equivalent of the Prize(s) based on the ARV published in these Official Rules. If Sponsor so elects, a potential Prize winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Giveaway will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Giveaway as determined by Sponsor in its sole discretion.
10. LIABILITY RELEASE / FORCE MAJEURE: Each person who enters the Giveaway does so at their own risk. By participating in the Giveaway, each entrant (A) hereby releases and agrees to hold the Giveaway Entities harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Giveaway or any Giveaway-related activity, or the receipt, use or misuse of any Prize, and (B) acknowledges that the Giveaway Entities have not made any warranty, condition, representation or guarantee express or implied, in fact or in law, with respect to any Prize and HEREBY SPECIFICALLY DISCLAIM ALL SUCH WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The Giveaway Entities shall have no responsibility for any damage to an entrant's computer system that is directly or indirectly caused by accessing or downloading content from the Website or otherwise participating in the Giveaway, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, dropped or delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, the Giveaway Entities are not responsible for incomplete, illegible, misdirected, late, lost, damaged, stolen, or postage-due entries or redemption documents; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any Prize or in any Prize notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right, without prior notice and at any time, to terminate the Giveaway, in whole or in part, or modify or suspend the Giveaway in any way, including if it determines, in its sole discretion, that the Giveaway is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions have corrupted, destroyed or severely undermined the administration, security, fairness, integrity and/or feasibility of the Giveaway. Sponsor shall have the right to cancel, terminate, modify, suspend or extend the Giveaway for any reason, including in the event Sponsor is prevented from awarding prizes or continuing with the Giveaway as contemplated herein by any event beyond its control, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, natural or man made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence). If the Giveaway is terminated, in whole or in part, before the designated end date, Sponsor may select winners (or the remaining winners, as the case may be) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Only the type and quantity of Prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of Prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of Prizes available in the Prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such Prize(s). Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. Any Prizes that are not duly claimed in accordance with these Official Rules will not be awarded. Any attempt by an entrant or any other individual to deliberately damage the Website or undermine the legitimate operation of the Giveaway, or to annoy, abuse, threaten or harass any other person, is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of Sponsor.
11. MISCELLANEOUS:
a. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the participant or Sponsor in connection with the Giveaway shall be governed by and construed in accordance with the internal laws of the State of Oregon without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
b. ARBITRATION: By participating in this Giveaway, all participants agree that (1) any and all disputes they may have with, or claims they may have against, the Giveaway Entities relating to, arising out of or connected in any way with (i) the Giveaway, (ii) the awarding or redemption of prizes, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually, without resort to any form of class or representative action, and exclusively by final and binding arbitration administered by the National Arbitration Forum (the "Forum" ) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum; (2) This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the United States Federal Arbitration Act ("FAA" ), 9 U.S.C. §§ 1-16; (3) The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure (provided such location is reasonably convenient for participant), or at such other location as may be mutually agreed by the participant and Sponsor; (4) The arbitrator's decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Giveaway; (5) The arbitrator shall apply Arizona law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant's and/or Sponsor's individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) The arbitrator shall not have the power to award punitive damages against the participant or Sponsor; (8) In the event that the administrative fees and deposits that must be paid to initiate arbitration against Sponsor exceed $25, and the participant is unable (or not required under the applicable Code of Procedure) to pay the additional fees and deposits, Sponsor agrees to pay them and/or forward them on the participant's behalf, subject to ultimate allocation by the arbitrator. In addition, if the participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the participant's filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Code of Procedure established by the Forum, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein.
