SurfToSkiRetreats.com is only a venue that acts as an online marketplace for vacation rental property owners/manager/agents to list their vacation rentals and have vacationers find vacation properties to rent. Surf to Ski Retreats is not a broker, lender or seller. Surf to Ski Retreats is not a party to any agreement you may make with a vacationer, or owner.
Notice to All Guests, Registered Vacationers and Vacation Rental Owners
SurfToSkiRetreats.com assumes no responsibility and in no way warrants the accuracy of information contained within this website. You are responsible for conducting your own investigation regarding any and all claims by potential renters or vacation rental owners and their respective listing. You assume all liability for use of any information you find within this website. The staff of this website does not confirm user entered content, such as rental listing information, or messages from vacationers. It is up to you to do your due diligence before renting to ensure the information presented to you is accurate.
Registration
You must register with Surf to Ski Retreats in order to use certain features of this website. When registering, you must provide current, complete, and accurate information about yourself. Your information shall be subject to the terms and conditions of the privacy policy and you further agree to update your profile information in order to keep it current.
Vacationers/Renters/Travelers
Before renting a vacation rental listed on this website, it is recommended you take several actions to ensure no fraud is being committed, including, but not limited to:
Speaking with the vacation rental owner over the phone
Requesting additional photos of the vacation rental
Obtain references from previous vacationers of the vacation rental
Obtain, and read, the rental agreement
Understand the refund and cancellation policy of the vacation rental/owner/property management company
Surf to Ski Retreats is not responsible for any costs associated with any losses incurred as a result of information presented on this website. Furthermore, we are not responsible for any refund, loss of refund or rental fees you may be subjected to above and beyond posted or non-posted rental rates. Owners are encouraged to disclose all policies and fees. As a renter, it is your responsibility to obtain and fully understand the owner's rules, regulations or policies. We recommend that you purchase trip cancellation insurance to best protect yourself against fraud, acts of God, or any event that may prevent you from participating in your trip as expected.
Surf to Ski Retreats is not responsible, or liable, for any action, omission or incorrect statement on the part of vacation rental owners that vacationers may experience by using this website. If you experience an unfortunate event, you are encouraged to notify your local authorities to help you rectify the situation. Notifying Surf to Ski Retreats is helpful so that we may take preventative actions to protect your fellow vacationers.
Online Booking (Reservations)
When a property is made available for online booking, you may choose to use this service to reserve the property. You are obligated to complete the transaction with the property manager. If you book the property through our service you must inform the property manager of your intent to cancel in accordance with their cancellation policies. You acknowledge that any agreement governing the terms and conditions under which you have rented a property are EXCLUSIVELY between you and the property manager, and that Surf to Ski Retreats is not a party to that transaction, notwithstanding the fact that Surf to Ski Retreats may have facilitated the transaction via this website.
By utilizing this site to reserve a vacation rental you agree to conduct your own investigation (prior to booking) regarding the property offered as a vacation rental and acknowledge that vacation rental owners and managers, not Surf to Ski Retreats, are responsible for the accuracy of the information in their advertisements and it is your responsibility to rent a listing on terms and conditions acceptable to you.
You understand that a confirmation of your rental request from Surf to Ski Retreats does not constitute a reservation for the property. You must receive such confirmation directly from the property manager. You should assume that the reservation is not confirmed until all payments have been received by the property manager, and all of the terms and conditions of the rental agreement have been agreed upon. Each property manager has differing policies for rates, deposits, fees and other various rental terms. It is solely your responsibility to confirm and understand all terms before making a reservation via this website.
By utilizing our service to reserve your rental, you are giving permission to Surf to Ski Retreats to encrypt a copy of your credit card information, and to pass that encrypted credit card information to the property manager, so that the property manager and you can complete the rental transaction. Surf to Ski Retreats will take all commercially reasonable efforts to ensure the security of the credit card information it stores in its files. Surf to Ski Retreats has no control over how the vendor, or property manager, will accept or store your credit card information, and makes no warranty against and takes no responsibility for their storage or misuse of the credit card information we pass on to them.
Surf to Ski Retreats is not a party to any rental transaction initiated, or booked, via this website. Surf to Ski Retreats neither owns nor contracts for any vacation rental property listed on this website. Instead, this website is a venue that allows property managers or property owners to list vacation properties for rent and for people interested in vacation rentals to rent such properties. Surf to Ski Retreats is not involved in the actual transaction between a property manager or owner or vendor and a renter. Although Surf to Ski Retreats provides features, such as online booking, that enable a renter to enter into a transaction to rent a specific property directly from a property manager and that information is sent to the property manager. As a result, Surf to Ski Retreats has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of property managers to rent the properties listed or the ability of renters to pay for the rentals. Consequently, Surf to Ski Retreats cannot ensure that property managers and renters will actually complete a transaction and does not make any representations as to the quality, location, availability, suitability, or pricing of any specific property.
Vacation Rental Inquires & Emails
All messages (to owners, to Customer Support and via "Email A Friend") are saved to our database and are monitored for spam, inappropriate conduct, unprofessional messages or illegal use of this website. We reserve the right to block users from sending messages, modify messages in our database, or purge messages that do not conform to these terms and intended use of the website. Inquires to vacation rental owners are subject to viewing by Surf to Ski Retreats staff.
Inquires are sent via email and stored in our database. Due to various factors out of our control, email is not 100% and at times your inquiry may be delayed or lost. Surf to Ski Retreats is not responsible for lost or delayed inquires. Should you not receive a response from the owner, you should try again as well as contacting the owner via phone, if listed. Do not contact the Surf to Ski Retreats Customer Support Team regarding vacation rental reservations.
Owners
Owners must pay to have their vacation properties listed on this website. All our products, services and associated costs are listed on our products page. Owners do not pay any surcharge, or fee, for obtaining or booking a reservation through this website beyond the basic listing price and any upgrades selected by the owner. There are no hidden costs associated with listing or booking on this website. You act as your own broker when vacationers inquire about your vacation rental. Surf to Ski Retreats is not a party to negotiations between you and the vacationer.
As a vacation rental owner (property owner, manager or agent), you are responsible for the accuracy of your vacation rental listing, including but no limited to the accuracy of pictures, location, descriptions, rates, policies and availability. By submitting photographs either electronically or by mail you are representing that you hold the intellectual property rights to each photograph or that you have properly secured the copyright rights. All content (material, images, text) published on this website is the property of Surf to Ski Retreats and we reserve the right to disable any vacation rental listing, without compensation, that violates decency rules, is reported to be fraudulent, disobeys any of our terms of use, or any reason.
Owners are responsible for conducting their own investigation prior to renting their vacation rental to a vacationer. Surf to Ski Retreats is not responsible, or liable, for any damages caused to a vacation rental by a vacationer who used this site to initiate communication with a vacation rental owner. Owners should have adequate insurance to cover damage or loss or any kind.
This website is designed, and optimized, to advertise one physical vacation property per listing. Combining more than one vacation property into one listing is a violation of this agreement. Should you sell your property and purchase another, you may edit your listing to reflect the new property. However, if you transfer the old property's listing to the new owner, you will be required to create, and pay for, a new listing.
Should you disable your vacation rental listing, for any reason, you will not be compensated, or refunded, for the time it is not visible to the general public. The expiration date for all products associated with a disabled listing will remain in effect and not be altered.
Owners are responsible for understanding, collecting and paying all local taxes, fees, permits or licenses. You should also be aware of any safety compliance regulations in your area.
Surf to Ski Retreats reserves the right to refuse any listing submitted to us for no reason and the owner specifically agrees to hold us harmless for any loss or liability that may arise from such a decision.
If Surf to Ski Retreats receives a complaint from a vacationer who has rented your vacation rental which we, acting reasonably, considers to be justified, or if you double-book a property for multiple vacationers during the same time period, or if you engage in any business practice that would be considered within the vacation rental industry to be unfair, or if you are in breach of your obligations to Surf to Ski Retreats, then we reserve the right to remove the vacation rental listing from the website without notice.
Surf to Ski Retreats reserves the right to change the look and feel, layout, and functionality of the website at any time without notice.
All payments made to Surf to Ski Retreats must be in US dollars. Owners may pay online with a credit card, or by mail using a US dollar money order or check drawn on a US bank. When paying by mail, no discount or promotion may be used. Promotions are available for online use only. Surf to Ski Retreats does not encourage payment by mail. We are not liable for lost, delayed or stolen payments thus resulting in the delay of product activation.
Transferring Listings
If you sell your vacation property and wish to transfer the listing to the new owner, please contact us and we will be happy to assist you for a small one time fee. Please see our products page for current prices on all our products and services. No refund will be given on any outstanding time on your listing, or any products associated with the listing. We encourage the seller and buyer to come to an agreement for fair division of any remaining listing costs or time.
Surf to Ski Retreats does not endorse the open selling of listings between owners. Such practices must be limited to a fair price between buyer and seller of a physical property and as part of that deal includes the transfer of a vacation rental listing. Any listing that advertises itself as for sale (the listing, not vacation rental) is subject to immediate cancellation without notice or refund.
No Spam Allowed
Surf to Ski Retreats does not tolerate spam of any kind. The tools we provide are to be used for their intended advertised purpose. You may not use this website to send spam, solicit owners, promote unauthorized websites or conduct commercial business of any kind. Such activities violate the intended purpose of this website. We reserve the right to suspend or cancel any membership that violates these terms. The Surf to Ski Retreats staff is the sole judge in determining what constitutes spam.
Service Availability
Surf to Ski Retreats staff strives to have the highest possible uptime for the website, but if we are unable to provide the promised level of service for any reason, including, but not limited to service outages, acts of God, war, disruption of telecommunications or negligence, neither Surf to Ski Retreats, nor its owners can be held liable for any costs inccurred due to interrupted service. We do not guarantee the website will be available 100% of the time.
Limitation of Liability
IN NO EVENT WILL SURF TO SKI RETREATS LLC. BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THIS AGREEMENT OR YOUR USE OF THE SERVICE, EVEN IF SURF TO SKI RETREATS LLC HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU ARE DISSATISFIED WITH THE SERVICE, YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST LMB WITH RESPECT THIS AGREEMENT OR THE SERVICE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE.

YOU HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE SURF TO SKI RETREATS LLC AND ITS AFFILLIATES, PARTNERS, SERVICE PROVIDERS, VENDORS, AND CONTRCTORS AND EACH OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, AND ALL OTHER RELATED PERSONS OR ENTITIES FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABLITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE SERVICE.
This agreement shall be constructed in accordance with the law of the State of Oregon; any and all disputes shall be submitted to the jurisdiction of Oregon, disregarding conflicts or law, forum and venue.

YOU HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE SURF TO SKI RETREATS LLC AND ITS AFFILLIATES, PARTNERS, SERVICE PROVIDERS, VENDORS, AND CONTRCTORS AND EACH OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, AND ALL OTHER RELATED PERSONS OR ENTITIES FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABLITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE SERVICE.
This agreement shall be constructed in accordance with the law of the State of Oregon; any and all disputes shall be submitted to the jurisdiction of Oregon, disregarding conflicts or law, forum and venue.
